Cativae Content Provider Agreement

By uploading any content to Cativae (“Content”), you agree to the following terms:

1. Representations & Warranties

• I certify that every individual depicted in the Content is at least 18 years old (or the age of majority in their jurisdiction) and I possess a valid, government-issued photo ID and signed model release for each person, which I will supply to Cativae within 24 hours upon request.
• I own all necessary rights to the Content or have obtained written permission from all rights-holders.
• The Content does not depict minors, bestiality, incest, rape, sexual violence, trafficking, prostitution, hate or any non-consensual activity, nor does it infringe any law or third-party right.

2. License Grant

I grant Cativae a worldwide, non-exclusive, royalty-free, sublicensable, perpetual license to host, reproduce, modify, distribute, display and create derivative works of my Content in connection with the Service.

3. Content Standards & Moderation

Cativae enforces strict content rules. All uploads are scanned by AI (AWS Rekognition) and, if flagged, are held for manual review. Prohibited Content (as listed above) is removed immediately, the account may be suspended or terminated without refund, and repeat violators are permanently banned. I will not use marketing terms or metadata that imply under-age or non-consensual content (e.g., “teen,” “rape”).

4. Indemnification

I agree to indemnify, defend and hold harmless Cativae and its affiliates, officers, agents and employees from any claims, damages or liabilities arising out of my Content or my breach of this Agreement.

5. Record Retention & Cooperation

I will retain all model releases and age/identity records for a minimum of five (5) years and will cooperate with any DMCA, CSAM, or legal takedown request in accordance with Cativae’s DMCA Policy.

6. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Delaware. Any dispute shall be resolved by binding arbitration under AAA rules in Wilmington, DE.

7. Acceptance

By clicking “I Agree” or by uploading any Content, I certify that I have read, understood and agree to this Content Provider Agreement.
