Service Provider Status

The system (“SYSTEM”) supporting this website qualifies as a “Service Provider” within the meaning of 17 U.S.C. § 512(k)(1) of the Digital Millennium Copyright Act (“DMCA”). Accordingly, it is entitled to certain protections under the DMCA safe harbor provisions. We respect the intellectual property of others and expect our users to do the same. We hereby adopt the following Notice and Takedown Policy relating to claims of copyright infringement.

Please do not send other inquiries or information to our Designated Agent. Abusing the DMCA Notice procedures or misrepresenting facts may result in legal liability, including damages, court costs, and attorney’s fees under 17 U.S.C. § 512(f).

Take Down Procedure

Upon receipt of a valid DMCA Notice, our SYSTEM will promptly remove and/or disable access to the infringing material and will notify the affected user. If the notice does not comply with the DMCA requirements, we may contact the complaining party to obtain the necessary information. Affected users may submit a counter-notification as set forth below.

DMCA Counter-Notification Procedure

If you believe that your material has been removed or disabled in error, you may submit a counter-notification. Your counter-notification must include:

Upon receipt of a DMCA-compliant counter-notification, we will forward it to the original claimant. Unless we receive notice of a court action seeking an injunction, we will restore the material within 10-14 days of receiving the counter-notification.

Service Provider Customers or Subscribers

If an alleged infringer is itself a “Service Provider” as defined by the DMCA, any DMCA Notices relating to claims of infringement by third-party users should be submitted directly to that Service Provider’s designated agent rather than to Cativae.

Modifications to Policy

Cativae reserves the right to modify, alter, or add to this DMCA Policy at any time. All users should regularly review this policy to ensure compliance.
