Affiliate Program Policy

1. Program Overview & Acceptance
The Cativae Affiliate Program ("Program") enables approved members (“Affiliates” or “you”) to earn referral-based discounts and commissions by lawfully promoting our premium subscription services. By applying, receiving, generating or using a referral code or link, or by receiving any benefit under the Program, you agree to be bound by this Affiliate Program Policy ("Policy"), the Terms of Service, Privacy Policy, community/content rules, and all applicable laws and regulations. If you disagree with any provision, do not participate.
This Policy is drafted to satisfy high‑risk payment industry expectations (including CCBill style compliance) even though *affiliate payouts are currently handled manually via PayPal* and not processed through CCBill at this time.
2. Eligibility Requirements
- Age: You must be at least 18 years old (or the age of majority in your jurisdiction if higher).
- Account Status: Your Cativae account must be active, age verified, in good standing, and not suspended, soft-blocked, or under investigation.
- Territorial Restrictions: We may reject or terminate affiliates in countries subject to U.S. sanctions, export controls, embargoes, or heightened compliance risk.
- Identity & Verification: We may request KYC (Know Your Customer) documentation (e.g., government-issued ID, proof of address, business registration) prior to approval, before payout, or at any time for re‑verification.
- Business vs. Regular Affiliate: Approved *Business* accounts may access enhanced commission tiers (see Section 6) upon proof of legitimate business activity (e.g., registered entity, tax number, marketing brand, or platform audience).
- Denied Applications: Rejected applicants may reapply only after addressing cited deficiencies. We have no obligation to disclose the full basis of rejection.
3. Enrollment & Affiliate Codes
- Application: Complete the affiliate request form in your dashboard or via designated onboarding channel.
- Review: We review applications for compliance, content quality, brand fit, traffic sources, and potential fraud risk.
- Approval: Upon approval you receive a unique referral code and (optionally) a custom landing URL. Codes are not transferable, sublicensable, or saleable.
- Code Format: Codes must not be altered, obfuscated, resold, mass-posted to discount sites, or injected into user browsers by extensions or scripts without explicit written permission.
- Inactive Codes: Codes with no valid conversions for ≥ 180 days may be deactivated at our discretion.
4. Promotional & Marketing Standards
4.1 Permitted Channels (Subject to Ongoing Compliance)
- Your owned websites, blogs, or forums (must have transparent ownership, functioning privacy/terms pages, and no prohibited content).
- Email newsletters (only to opt‑in recipients; include unsubscribe link & comply with CAN-SPAM/GDPR/anti-spam laws).
- Social media pages/groups you control (no impersonation of Cativae staff or official pages).
- Direct messaging to consenting adults where not unsolicited/spammy.
- Paid ads *only with prior written approval*—including search, social, native, adult networks—ensuring no bidding on Cativae trademarks or confusingly similar variations (see 4.3).
4.2 Prohibited Practices
- Spam (email, forum, comment, SMS, chat, automated bot posting, unsolicited DMs).
- Misrepresentation, fake endorsements, fabricated pricing claims, undisclosed sponsorship.
- Use of malware, adware, forced clicks, cookie stuffing, iframe cloaking, or toolbars injecting codes.
- Incentivized sign‑ups offering compensation unrelated to genuine interest (e.g., pay-to-join schemes, credit card farming).
- Any content involving minors, simulated minors, exploitation, non-consensual acts, doxxing, harassment, hate, or otherwise violating our platform standards.
- Purchasing subscriptions through your own code for self-discounting (self-referrals) or using others' payment methods without authorization.
- Registering domains or handles that contain or closely mimic Cativae trademarks, brand names, or typosquats.
4.3 Trademark & Brand Usage
You may use approved textual references to “Cativae” or “Cativae Premium Lifestyle” strictly to describe the program. You may not:
- Use logos, design marks, UI screenshots, or proprietary graphics without prior written permission.
- Bid on or purchase ads targeting our trademarks, including misspellings.
- Register social handles implying official affiliation (e.g., @CativaeOfficialAffiliate).
4.4 Disclosure & Transparency
All promotional content must include clear FTC/ASA-compliant disclosure of the affiliate relationship (e.g., “I may earn a commission or discount if you use my code”). Disclosures must be proximate to the endorsement—NOT hidden in a footer.
5. Tracking, Attribution & Validation
- Manual Handling During Initial Phase: At present, affiliate subscription discounts and related commission calculations are handled manually. A conversion is recognized when a new subscriber uses your code during a valid subscription purchase.
- Attribution Window: Discount is applied at point of sale only when the code is actively entered; no retroactive application for missed entries unless approved as a one‑time courtesy.
- Multi-Code Conflicts: If multiple codes are attempted, only the final accepted code on the completed transaction is credited.
- Fraud Review: Transactions flagged for chargeback, fraud, payment dispute, or policy breach may be reversed or held pending investigation.
- Data Integrity: We may introduce automated tracking, dashboards, or 3rd‑party affiliate software in future; updated mechanics will supersede manual processes upon notice.
6. Discount & Commission Structure
Affiliates provide referral *discounts* to new subscribers and may receive *commissions* or *discount credits* as determined by Cativae. Current base structure:

6.1 Adjustments & Caps
- We may introduce performance tiers, minimum activity requirements, or caps to mitigate abuse.
- Discounts cannot exceed published maximums without a signed amendment.
- Transactions refunded or charged back within 60 days are ineligible.
6.2 Self-Referrals
Using your own affiliate code on your own subscription is prohibited and voids related benefits.
7. Payouts & Settlement
- Current Method: Manual settlements issued via PayPal only (subject to availability). You must supply a valid PayPal email matching your verified identity.
- Minimum Threshold: Default payout threshold is US $50 in cleared commissions unless otherwise stated.
- Frequency: Reviewed monthly; payouts typically processed within 30 days after the close of the month in which commissions become cleared.
- Hold Period: We may apply a 30–60 day hold to mitigate chargeback risk before releasing funds.
- Fees: Any PayPal or transfer fees are deducted from your payout.
- Unclaimed Funds: Payouts unclaimed for 180 days revert to Cativae.
Future Integration Notice: If we later integrate automated payout processors (e.g., CCBill affiliate settlement), you may be required to accept updated terms and re-onboard to continue earning.
8. Taxes & Regulatory Compliance
- You are solely responsible for reporting and paying all taxes arising from commissions (including income, VAT/GST, self-employment taxes).
- We may require completion of tax forms (e.g., W‑9, W‑8BEN) before releasing payouts and may withhold amounts where legally required.
- Failure to supply required tax information within 90 days of request may result in suspension or forfeiture of accrued, unpaid commissions.
9. Fraud, Audit & Investigation
- We actively monitor for anomalous conversion patterns (e.g., high refund rate, clustering of sign‑ups from identical IP ranges, disposable emails, mismatched geographies).
- We may suspend code usage, freeze payouts, or retroactively reverse commissions pending review.
- You agree to cooperate with any audit requests within 7 calendar days (traffic logs, source screenshots, campaign IDs, etc.).
- Confirmed fraud or material breach triggers immediate termination and forfeiture of unpaid commissions.
10. Data Protection & Privacy
You must process any personal data gathered in your promotional activities in full compliance with applicable privacy laws (e.g., GDPR, CCPA). You are an independent controller with respect to your own marketing lists. You must not receive or request end‑user login credentials, payment details, IDs, or sensitive personal data. Any sharing of user data with you beyond anonymized conversion reporting requires explicit written authorization.
11. Intellectual Property
All Cativae trademarks, service marks, logos, graphics, interfaces, and platform content remain the exclusive property of Cativae. You receive no license beyond a limited, revocable right to use plain text references solely to promote legitimate subscriptions. Unauthorized adaptation, scraping, framing, reproduction, or distribution of protected content is prohibited.
12. Independent Contractor Status
No agency, partnership, joint venture, franchise, employment, or fiduciary relationship is created by this Program. You may not bind Cativae to any obligation or represent yourself as an employee or agent. You are solely responsible for your expenses, infrastructure, marketing, and legal compliance.
13. Suspension & Termination
- Convenience: Either party may terminate participation at any time upon written (including electronic) notice.
- Cause: We may immediately suspend or terminate for policy breach, suspected fraud, reputational risk, legal risk, or inactivity.
- Effect: Upon termination you must cease all use of affiliate codes, remove promotional materials, and discontinue representing yourself as an affiliate.
- Forfeiture: Unpaid commissions tied to fraudulent, non-compliant, or reversed transactions are void. Legitimate accrued commissions above the threshold may still be paid at our discretion after final review.
14. Disputes & Adjustments
- Notice Window: You must submit any commission or tracking dispute within 30 days of the close of the month in which the disputed transaction was (or should have been) recorded.
- Documentation: Provide reasonable evidence (traffic logs, timestamps, referral context). Unsupported claims may be denied.
- Binding Decision: Cativae’s good-faith determination after review is final.
15. Modifications
We may update this Policy (including commission tiers, payout frequency, eligibility, prohibited practices) at any time. Material changes will be posted with a revised “Last Updated” date. Continued participation after the effective date of changes constitutes acceptance. If you object, your sole remedy is to terminate participation.
16. Disclaimers & Liability Limitation
The Program is provided “as is” without warranties (express or implied) regarding uptime, tracking accuracy, future availability of specific commission rates, or error-free operation. To the maximum extent permitted by law, Cativae is not liable for indirect, incidental, special, punitive, or consequential damages, lost profits, lost data, or business interruption arising from or related to this Program. Aggregate liability shall not exceed the total commissions paid to you in the preceding three (3) months.
17. Governing Law & Venue
This Policy shall be governed by the laws specified in the Cativae Terms of Service (without regard to conflict of law principles). Any dispute shall follow the dispute resolution procedure in the Terms of Service, unless otherwise mandated by applicable law.
19. Acknowledgment
By applying for, activating, or using an affiliate code you acknowledge that you have read, understood, and agree to this Policy and represent that all information you supply is accurate and complete.
