Statement of Purpose

Cativae ("Cativae," "we," "us") operates www.cativae.com, an online social network for consenting adults interested in the swing lifestyle. This is not an escort, pornography, or live‑cam service. All value is delivered online via community features (search, chat, events). No physical goods are offered.

1. Age Verification & §2257 Exemption

2. Acceptance of Terms

These Terms constitute a binding agreement between you ("User") and Cativae governing your use of the Service. 3. Description of the Service

The Service enables Users to create profiles, search other members, participate in private and group chats, and RSVP to lifestyle events. Cativae is provided "as is" and may change, suspend, or discontinue any part at any time.

4. Content Standards & Explicit Content Blocking

Users may upload content freely; non-explicit material is published immediately. Any upload flagged as explicit or prohibited is automatically blocked from view pending manual review.

5. Payment & Subscription Terms

Cativae offers four recurring plans:

Your selected plan will automatically renew until cancelled. Charges will appear as "CT‑CATIVAE.COM *844‑XXX‑XXXX" on your statement.

You may cancel at any time via Account → Billing or by e‑mailing support@cativae.com. Cancellation stops future charges immediately and retains access until the end of the current paid period.

No pro‑rated refunds are issued for unused subscription time except as required by law.

6. Refund Policy

First‑time subscribers may request a full refund within 7 calendar days of the initial transaction, provided no Terms violations occurred.

Refunds are processed to the original payment method within 3 business days; bank posting times may vary.

7. Safety & Offline Meetings

Cativae does not conduct criminal background checks. You are solely responsible for your interactions online and offline. Exercise caution and review our Safety Tips before arranging meetings.

8. User Responsibilities & Prohibited Conduct

You agree to provide accurate information and abide by all laws. Prohibited conduct includes harassment, impersonation, malware distribution, and non‑consensual sharing of content. Cativae may suspend or terminate accounts for violations.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” CATIVAE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

10. Limitation of Liability

To the fullest extent permitted by law, Cativae shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless Cativae and its officers, directors, employees, and agents from any claims arising out of your use of the Service or violation of these Terms.

12. Dispute Resolution & Arbitration

Before initiating arbitration, you and Cativae agree to attempt informal resolution for 30 days after written notice. Unresolved disputes shall be settled by binding arbitration under the rules of the American Arbitration Association in New Castle County, Delaware. You waive any right to a jury trial.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict‑of‑law principles.

14. Force Majeure

Cativae is not liable for delays or failures resulting from causes beyond its reasonable control, including natural disasters, acts of government, or internet outages.

15. Data Retention & DMCA Takedown

We retain moderation logs for 5 years, ID-verification records for 3 years, and backup data for 12 months. See our Privacy Policy for full details.

16. Complaint & Appeal Policy

Users may report content via the in-site “Report” tool. We acknowledge every report within 24 hours and resolve actionable complaints within 7 business days. Moderation decisions may be appealed by emailing appeals@cativae.com, and will be reviewed within 7 days.
